Large Brazilian and other Latin American multinationals may face claims based on alleged misstatements in their corporate disclosures in different countries, in litigation and arbitration. Our panel will discuss in particular parallel proceedings in securities class actions in the United States, arbitration in Brazil and in litigation in the Netherlands with respect to Petrobras, the largest Latin American company.

11.30: Session two: The most challenging enforcement cases under the New York convention

A successful party in arbitration is looking for voluntary compliance with the award by the debtor or it may have to bring enforcement proceedings. Meanwhile, a losing party may be relying on judicial proceedings to fight recognition of an award that it believes should never been issued against it. This panel will discuss a selection of thorny enforcement cases, some of which have led to opposite outcomes in different jurisdictions.
